Jen Gassiraro Art (the "Artist") is committed to protecting the privacy and security of its Clients and website visitors. The Artist will not sell, trade, or rent personal information to third parties. All data collection is conducted in accordance with the terms outlined below.

2. Collection of Personal Data

The Artist collects personally identifiable information only when voluntarily provided by the Client. Data collection occurs during the following actions:

  • Order Placement & Invoicing: Collection of contact information (name, shipping address, email) and payment information.

  • Account Registration: Collection of credentials and contact details to facilitate future transactions.

  • Marketing Subscriptions: Collection of email addresses for the distribution of newsletters, including updates on new artwork, promotions, and studio offers.

Contact information is not stored for general website visitors until the formal creation of an account or the initiation of a transaction.

3. Use of Cookies and Tracking Technologies

This website utilizes cookies—small text files stored on your computer or mobile device—to enhance user experience and site functionality.

  • First-Party Cookies: Used to store Client details necessary to carry out essential services and maintain session integrity on the site.

  • Third-Party Cookies: Used to collect anonymized statistics and analyze website traffic patterns to improve service delivery.

4. Disclosure of Information to Third Parties

The Artist will only share personally identifiable information with third parties under the following circumstances:

  • Consent: When the Client has provided express permission to share said information.

  • Service Fulfillment: When sharing information is necessary to provide a requested product or service. This includes, but is not limited to, providing contact and address details to third-party shipping and logistics partners for the delivery of artwork.

  • Legal Requirement: When required by law to comply with legal processes or protect the rights and safety of the Artist.

5. Data Security

The Artist employs industry-standard measures to protect the security of personal data. However, no method of transmission over the internet is 100% secure, and the Artist cannot guarantee absolute security of electronic information.

Terms and Conditions 

Terms and conditions below outlines the legal agreement between Jen Gassiraro Art (the "Artist") and the individual or entity purchasing artwork (the "Client"). By completing a purchase on this website or paying an invoice issued by the Artist, the Client agrees to be bound by the following terms.

1. Scope of Agreement

The following policies apply exclusively to artwork purchased directly through this website or via an invoice issued by the Artist. For Jen Gassiraro artwork purchased through third-party galleries, retailers, or secondary markets, the Client is bound by the specific return and exchange policies of that entity and must contact them directly for resolution.

2. Non-Commissioned & Non-Custom Artwork

For all ready-to-ship, non-commissioned artwork, the following terms apply:

  • Return Window: The Client has a period of three (3) calendar days from the date of delivery confirmation to initiate a return request. Requests received after this period will be void and ineligible for consideration.

  • Initiation: To initiate a return, the Client must email jen@jengassiraroart.com stating the artwork title and the specific reason for the return. The Artist reserves the right to request additional information or documentation.

  • Shipping and Liability: The Client is responsible for all costs associated with return shipping. The artwork must be professionally repackaged to ensure safe transit. The Artist is not responsible for items lost or damaged during return transit.

  • Refund Eligibility: Refunds are contingent upon the artwork arriving at the studio in its original, unaltered, and undamaged condition (e.g., paper works must not be cropped, trimmed, or mounted).

  • Processing: Approved refunds will be issued to the original form of payment. International refunds are remitted in USD and are subject to the exchange rate at the time of processing.

3. Custom and Commissioned Artwork

All custom and commissioned projects are final sale and are not eligible for return, exchange, or refund.

  • Deposit: A non-refundable deposit of 50% of the total project fee is required following the initial consultation. This fee covers administrative costs and materials and must be paid before work commences.

  • Final Payment: The remaining 50% balance is due upon completion of the artwork and prior to shipping or delivery.

  • Approval Protocol: The Client will be provided with "in-process" photographic updates and a final high-resolution image for sign-off. By paying the final invoice, the Client formally accepts the work in its current state. Delivery will be scheduled only after the final balance is settled in full.

4. Shipping and Handling

  • 4.1 Fulfillment and Carrier Selection: The Artist will professionally package and dispatch all artwork within the timeframe specified at the time of purchase or as outlined in the Commission Agreement. All shipments are fulfilled via reputable third-party carriers. The Artist reserves the right to select the carrier and shipping method most appropriate for the size and fragility of the artwork.

  • 4.2 Transfer of Risk: The risk of loss or damage to the artwork passes from the Artist to the Client upon delivery of the artwork to the carrier. The Artist is not liable for delays, mishandling, or losses incurred by the third-party carrier.

  • 4.3 Insurance and Valuation: All artwork is shipped with carrier insurance reflective of the full purchase price. For International Shipments, the Client is solely responsible for all customs duties, import taxes, and brokerage fees.

  • 4.4 Damage in Transit: In the event that an artwork arrives damaged, the Client must notify the Artist via email at jen@jengassiraroart.com within twenty-four (24) hours of delivery. The Client must provide clear photographic evidence of both the damaged packaging and the artwork. All original packaging materials must be retained for carrier inspection. Failure to comply with these requirements may result in the denial of a damage claim.

5. Intellectual Property and Copyright

The purchase of a physical painting or print does not constitute a transfer of copyright or intellectual property rights.

  • Ownership of Rights: Jen Gassiraro Art retains full and exclusive copyright to all artwork, including commissioned works. This includes the right to create, display, and sell reproductions of the artwork at the Artist's discretion.

  • Unauthorized Reproduction: No party may reproduce, scan, or create prints of Jen Gassiraro artwork without express written authorization from the Artist.

  • Copyright Transfer: Any transfer of copyright from the Artist to the Client requires a separate, written Licensing Agreement and is subject to an additional fee. Inquiries regarding rights transfers should be directed to jen@jengassiraroart.com.
